Wow - how complicated can this be? D Numbers, ID Numbers, Tax Numbers...it's all quite confusing and not one place explains it all easily. Bascially you need a tax deduction card and to get that, you need and ID number. But ID numbers can take some time (approx 3 months) to come through so in the interim you can go to the local police station and a get a D Number immediately - until your ID number comes through. You need that/those numbers to get a tax deduction card and a bank account - nothing happens without those. Need the forms? Applied for JSA today, which took forever and was A CHORE. Also, the person on the phone in April must have been an utter retard, because she got almost everything wrong about me on my form, even down to writing my reason for leaving Crooge as "customer left". WTF?! Seriously, if after 2 years of waitressing that would make me leave... well, that person clearly never worked in customer service. Except for how that was her job. Fortunately, though that could well have jeopardized my application, the guy saw how much other stuff was wrong on the form, (phone number, address, NI number, Crooge address , bank account, application date...) and believed me that it should have said "moved house" instead. So I should all be good.... in two weeks' time. Gah! I want to have a job already by then. Oh well, I desperately need the money, so the backdatedness should kick in right when I'm in Narch for my visit. (25th-31st May) Thank fuck I'll get the money before expensive!time - sorry, Maelstrom. Also then I had a driving lesson with a new instructor which went appallingly. I wasn't used to his style of teaching or the car so I fucked up a lot at the beginning, and he then decided to treat me like an annoying retard for the rest of the lesson: "Hmm, perhaps a gear change would be nice?" I am sick of being treated like I have 25% of the intelligence I do. I think I'ma gonna go study me some biochemistry and apply for an MsC. And then derive pi to a thousand places. With a soup spoon. Z has been super patient with my propensity to crumble under pressure, and I'll be the first to admit that he works a lot harder than I do, in all things. Except blogging. We took care of a lot yesterday, and it feels great to make so much progress, but of course there's still a lot to do. I'm going to write a couple of things for AOL today, then scurry back over to the condo to do some more cleaning/packing/emptying. Today's to-do list is a monster: 11am: Guy comes to look at the car. Hopefully he leaves with it. after lunch: Contact the bank about our refi application Go to Best Buy to look at smartphones. I'm still no closer to a decision, and in fact have broadened my search to include more than just the Blackberry and Treo. Dammit. Gym. I skipped yesterday, but that's okay because I'm STILL sore from the day before, and I did a lot of pushups and squats and heavy lifting, anyway. Shoe shopping. Clutch purse shopping -- I forgot that I need one of these, too. I guess "need" isn't the right word, but "want" doesn't describe it, either. I bought this really fancy new dress at the White House Black Market outlet (marked down from $160 to $20 -- fuck yeah!), and I plan to wear it in Vegas, but I can't just carry my hippie purse with it. I actually need something classy. And I've been feeling like I should have a classy purse for bridge tournaments anyway, because usually I'm dressed really nicely, but carrying around a canvas sack. I've never been big on handbags, but I guess it's a necessary part of the look I'm going for. So I need a clutch. Anyway. Emptying out Z's car, starting to pack it up Weight Watchers at 5:30 While I'm here working (I have done some work), Z has been to Goodwill with a carful of our stuff, the recycling center, and the car wash. What would I do without this guy? So that should make for a busy day -- but this is most of the big chores, and once everything is crossed off this list, the only real stressor left will be packing up. Good deal. Happy things: We're actually making progress, and I think we'll meet our deadline. We met with the property managers yesterday, and I'm pretty optimistic about the whole rental thing working out for us. The guy coming to see the car today sounds really interested. Fingers crossed. I'm going to Florida after Richmond! This was decided last night. Gail had been toying with the idea, and she decided she wants to take me down with her to play for a week and enjoy the sun and the escape from local bridge. Z will be at this tournament, too, but he and I won't be staying together. He's staying with his teammates, and I'm staying with Gail (and staying out of their way). That will be a strange arrangement, but I'm just thinking of it as two separate trips. I'm going somewhere, and Z's going somewhere, and they happen to be sort of similar places. But I'm not going to intrude on his time with this group. He's working hard to build relationships with this sponsor and his teammates, and I'll have my own thing going on down there. And it's going to be an effing blast. Family gathering at the river this weekend. Yay for Nelson County, nieces, and extended family! I have so much to look forward to this week/month/summer/year. Was speaking yesterday with a nice women that lived in California. Her father (also a California resident) died without a Will but leaving behind several children. Her parents owned a piece of real estate in Louisiana. She wanted to know what was needed to get the succession done and the property sold. I told her an ancillary succession was necessary. The easiest way to get this property sold was to: Have an Administrator appointed. Since there were many heirs, it was not going to be possible to get an "Independent Administrator" appointed. Have the Administrator petition the court to allow the listing of the property. Have the sale of the property approved by the court. This requires two advertisements in the parish where the property is located. The Administrator and the surviving spouse can then sell the property. Since the property was community property, half the proceeds would be payable to the surviving spouse, and half payable to the Succession. The Administrator must open a Succession bank account at any Louisiana bank and deposit the succession funds in the account. The surviving spouse will be entitled to the usufruct of these Succession funds until her death or remarriage. At that time, the heirs will be entitled to ownership of these funds. The Louisiana Succession - To Administer or Not To Administer | Top |
When a Louisiana resident dies owning assets titled in their name, a Louisiana succession is necessary so that the assets can be transferred to the proper heirs. The question typically is not whether a succession is necessary, but the question is often whether an "Administration" is necessary. Let's say, for example, that Dad died recently. Mom is still alive. Dad and Mom owned a home, two cars, a bank checking and savings account, and some stock in ABC, Inc. Dad left a Will naming Mom as executor, leaving Mom the lifetime usufruct of his estate, and naming his children as naked owners. Mom has signature authority over the bank accounts since they were joint accounts, and Mom is not interested in a quick sale of the house, cars or stock. This succession might be handled quicker and easier by skipping the Administration. We simply petition the court to place the heirs in possession of the estate without getting Mom confirmed as executor. With a signed Judgment of Possession, Mom can have the house title transferred, she can have the vehicles put in her name, and she can have the stock transferred out of Dad's name. End of story. If things are the least bit complicated, however, we have an Administration. Let's say now that Mom died with a Will leaving her estate to her children, and naming her son, Larry, as the executor. Mom's cars need to be sold, and no one has access to Mom's accounts to take care of Mom's final bills and other estate expenses. In this case, we need an Administration. We need to petition the court to have Larry confirmed as executor. Once confirmed, he can go to Mom's bank and collect her funds and deposit them in an estate account that he opens. As executor, he can sell Mom's vehicles and deposit the funds in the estate account. Once all of the estate's bills are paid, he can distribute the estate account to the heirs. Once we take good hard look at the assets and the family's objectives, we can determine whether an Administration of a Louisiana Succession is necessary. Let's keep this simple and say that Mom died recently. She and Dad owned two assets only: Stock in ABC, Inc. worth $1 million, and an additional $1 million of bank accounts. She left a Will providing that Dad is executor and Dad inherits the lifetime usufruct with naked ownership going to their children. Since Dad realizes the $2 million of assets are community property, Dad would like to name the children as the naked owners of all $1 million of the stock, and he would like to keep - as his portion of the total community property - the $1 million of cash. Dad does not want ownership of any appreciating assets because he wants to minimize estate tax at his later death. Can he do this? No, at least not in my opinion. Community property laws require that Dad continue to own a 1/2 community property interest in each asset. So Dad will continue to own half of the stock and half of the cash, and the children will be the naked owners of Mom's half of the stock and half of the cash subject to Dad's usufruct. The executor is not permitted to pick certain assets to fund Mom's one-half of the total community property. I think it's becoming an addiction. Argh. Seriously... Argh. I spend hours on this thing. Not on the game itself, but on the forums, trading items for other items. I ACTUALLY BOUGHT VIRTUAL COINS ($9.99 worth) FROM THE PET SOCIETY USING MY CREDIT CARD. &^$@#!!!! I really think I should stop playing this game... I am currently on level 33 and a couple of thousand points away from being a level 34 pet-- the highest level. MAYBE I will stop after I reach level 34... I don't get anything done with this game around...
